Overview

Michelle Farr and all entities associated with Born to be Envied Cattery will be referred to here on as “Breeder.”  

 

No part of any breeder correspondence may be copied, forwarded, or shared by the buyer. This includes but is not limited to phone calls, voicemails, text, email, private message, social media contact, posts, comments, and discussions. Any discussion of breeder that could be deemed slander, libel, or damaging to breeder may result in litigation and restitution. 

 

Costs

A non-refundable holding-fee of $500 is required to reserve an Ensoriental cat/kitten. This deposit will be deducted from the final price of the cat/kitten. Should the buyer decide not to adopt the cat/kitten listed in this contract, the holding-fee is either transferred to a different cat/kitten, or is forfeit.

 

Breeder accepts credit/debit card or cash for cat/kitten fee and transportation fee if applicable. Buyer is responsible for all transportation costs after 250 miles from Augusta, Georgia in addition to cat/kitten payment in full. Additional transport costs will be calculated based on a reasonable transportation method dependent on distance required to travel and can be defined separately. 

 

Cats/kittens being picked up in-person must be paid in full at or before pickup. Cats/kittens being transported must have cat/kitten fee and transportation fee paid in full five full days before travel.

 

Breeder is not liable or responsible for the welfare of the cat/kitten after it leaves the cattery. Whether that is by direct hand-off or courier or shipping of any kind. It is the buyers responsibility to have the cat/kitten insured appropriately. 

 

Reproduction

 

  • This cat/kitten is not for breeding purposes. 
  • This cat/kitten will be desexed before being transferred to buyers care.

Physical and Medical Care Expected of Buyer:

 

  • This cat/kitten will never be declawed.
  • This cat/kitten will be provided fresh water and high quality food at all times.
  • This cat/kitten will be provided with fresh litterboxes.
  • This cat/kitten will never be allowed outdoors except while on a leash while supervised, or in a fully-enclosed catio while supervised. This cat/kitten will never be an outdoors cat, and will never be allowed to roam freely outside.
  • This cat/kitten will never be denied veterinary care.
  • This cat/kitten will not be left alone for extended periods of time and will be provided enrichment activities, and this cat/kitten will be provided with appropriate scratching surfaces (cardboard or sisal scratchers are recommended.)
  • This cat/kitten will never be mistreated, neglected, or abused. If cat/kitten is found to be mistreated, neglected, or abused, the purchaser will surrender said cat or kitten to the breeder unconditionally. 

 

Transfer of Ownership

 

This cat/kitten will not be surrendered, sold, leased, or co-owned with any shelter, rescue, pet store, research laboratory, or any similar facility. Should the buyer no longer be able to care for the cat/kitten, buyer agrees to contact the breeder first for assistance in finding a new home. Breeder is to be given the first opportunity to receive cat/kitten back as a surrender if no longer wanted by the buyer for any reason.

 

Provided by Breeder:

Registration Paperwork

 

Registration paperwork for CFA and/or TICA will be provided for the cat/kitten within 6 months of sale at purchasers request. 

Breeder will provide copies of the cat/kitten’s medical history and vaccine records, and will provide a pedigree as requested. 

 

Microchip

 

This cat/kitten will be microchipped with an ISO microchip, which can be registered by the breeder as a convenience for the buyer. The buyer agrees to maintain/update the microchip registration in the event of a change in contact information.

 

DNA Testing of Breeding Cats

 

Breeder agrees to have performed DNA testing on the parents of all kittens. At the time of this writing, these genetic tests are performed via Optimal Selection Wisdom Panel. The breeder will inform the buyer of any known potential genetic issues discovered by DNA testing of the parentage. Other DNA tests do exist, and it is the buyer's prerogative whether or not to perform such testing on the cat/kitten at the buyer's own expense.

 

Health Guarantee

 

The breeder guarantees that the cat/kitten is free from infectious diseases, fleas, or parasites at the time of transfer or ownership. The buyer is recommended to take the cat/kitten to their veterinarian at their own expense for a wellness check within 72 hours of transfer of ownership should there be any concerns. 

 

  • Should the buyer feel that the cat/kitten is ill, the buyer agrees to contact the breeder immediately.
  • Buyer agrees that sometimes stress can cause a lack of appetite. 
  • Buyer understands that the cat/kitten needs to be transitioned with minimal stress to prevent physical concerns. 
    • Breeder recommends a quarantine period of at least 2-weeks if the cat/kitten is brought into a home where other cats are present. The breeder is not responsible for any illnesses or parasites the cat/kitten or other cats contract due to the quarantine-period not having been observed.
  • Exposure to any ill or contagious animals will void the health guarantee for this cat/kitten. 
  • In the event of serious illness or death of the cat/kitten, the buyer agrees to immediately inform the breeder. 
  • The breeder guarantees against genetic defects for the first three years of the cat/kitten's life. 
    • FeLV, FIP, and FIV are not considered genetic defects and are specifically excluded. 
  • Breeder guarantees the genetic health of kittens for three years. Should the cat/kitten be diagnosed with any genetically derived medical disorder not previously disclosed by the breeder to the buyer and that the buyer has agreed to purchase in spite of  within three years of birthdate- which is attested to by a veterinarian- seller will, upon the provision of veterinary reports, replace the cat/kitten when one is available. In the unlikely death of the cat/kitten prior to its third birthday, the buyer agrees to provide the breeder with a full necropsy report at buyers own expense. Should genetic defects be determined to be the cause of death, the breeder agrees to replace the cat/kitten with one of similar quality or refund the buyer's purchase price.
    • Consideration for refund is conditional upon the buyer releasing all veterinarian and necropsy records to the breeder, and buyer must give permission for the Buyer’s veterinarian to discuss the case with the breeder and the breeder’s veterinarian of choice.
    • Any other reason to refund will be provided solely at the Breeder’s discretion.
  • A free 30-day health insurance policy through Trupanion is provided with each cat/kitten. It is the buyer's responsibility to activate and maintain health insurance of the cat/kitten once it leaves the cattery. 
  • Health guarantee is void if ownership changes. 

 

This contract is legally binding to all parties involved. This sales agreement is non-transferable. Any changes, additions, or omissions to this contract must be agreed upon in writing by all parties. 

Breach of this agreement will result in the cancellation of all warranties and guarantees, but the contract remains in force. The breeder's maximum liability to the buyer for any and all losses, claims, damages, or liability of any kind will be limited to the amount paid by the buyer to the breeder under this agreement. 

The parties who have signed below have been afforded the opportunity to ask questions and have been answered to their satisfaction, and upon signing do concede that they understand and agree to this document's contents in its entirety. 

 

This agreement is to be interpreted by the laws of the state of Georgia.
